These Terms of Service ("Terms") govern your use of the GreenWeek website and scheduling application (the "Service"), operated by GreenWeek ("we", "us", "our"). By creating an account, joining the waitlist, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
GreenWeek is a scheduling assistance tool. It generates suggested weekly schedules based on the information you provide (customers, frequencies, preferences, locations).
GreenWeek only proposes. You decide. Every schedule generated by the Service is a draft suggestion that requires your review and approval. You — not GreenWeek — are solely responsible for the schedules you adopt, the visits you make or miss, and every business decision you take based on the Service's output.
Estimated times, drive times, and route orders are approximations and may be inaccurate. You must verify all schedules before relying on them.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that schedules generated will be complete, correct, or suitable for your business.
To the maximum extent permitted by applicable law: (a) we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, business, customers, or data — including damages arising from missed, late, duplicated, or incorrectly scheduled visits; and (b) our total aggregate liability for all claims relating to the Service shall not exceed the amounts you paid to us for the Service in the three (3) months preceding the event giving rise to the claim, or fifty Canadian dollars (CAD $50) if you have paid nothing.
Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless GreenWeek and its owner, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your schedules or business operations, your data, or your violation of these Terms or of any law or third-party right.
You retain ownership of the data you enter. We use it only to provide the Service, as described in our Privacy Policy. We do not sell your data.
You may not misuse the Service, attempt to access it by unauthorized means, interfere with its operation, or use it in violation of any applicable law.
We may update the Service and these Terms. If we make material changes to these Terms, we will notify you (for example by email or an in-app notice) before they take effect. Continued use after changes take effect constitutes acceptance.
We may suspend or discontinue the Service, in whole or in part, at any time. If we discontinue the Service entirely, we will: (a) give you at least thirty (30) days' advance notice by email; (b) provide a reasonable way to export your data before the shutdown date; and (c) refund any prepaid fees covering the period after the discontinuation date. Except for that refund, we shall have no liability to you or to any third party arising from the discontinuation of the Service.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute shall be resolved in the courts of British Columbia, Canada.
